The bread-and-butter program is what we can prospective coverage. Prospective coverage means that you perform some type of medical act today, perhaps an appendectomy and you're sued three months later. You are covered. Then the next program, which adds to the prospective coverage, is what we call Retroactive coverage. That means that you perform that appendectomy before you join, perhaps three months ago. Then, if you're sued three months later, you're covered. And then finally, we offer something called, PE Lite. So what is PE Lite? PE Lite means that you're already in the middle of a lawsuit and so typically you would not be able to purchase any type of coverage but Medical Justice offers what we call, "fire insurance while your house is burning down." So you can get coverage for an open case. It is a bit more expensive than the traditional bread-and-butter coverage, so you want to get on board sooner rather than later. Dr. Jeff Segal, MD, founder, and CEO of Medical Justice explains the real risk of practicing medicine and why it's important for ALL doctors to be prepared for the likelihood of being sued. As a neurosurgeon himself, Dr. Segal had a lawsuit brought against him. Even though the case was dropped and never went to court, he vowed to help other doctors from having a similar experience so they could do what they love; practicing medicine. Transcript What's the likelihood of being sued? Isn't it true that just bad doctors are sued? Well, actually not. Being sued is an occupational hazard of being a physician. Let me give you some sobering statistics: If you are a surgeon, the likelihood of you being sued by the age of 65 is approximately 99 percent. If you're a low-risk physician, the likelihood of you being sued by the age of 65 is 75 percent. So it's very difficult to go your entire career without being sued. Now the good news is that most of the time the doctor will prevail. But given how much emotional angst takes place while you're being sued, being on the right side, meaning prevailing or winning is cold comfort to most doctors. Most doctors would prefer never to be sued in the first place. Let me drill down a little bit further in terms of specialties. So my specialty, neurological surgeon, we're sued at the rate of about 19 percent a year. 19 percent a year. General surgeons, 15 percent a year. Orthopedic surgeons, 14 percent a year, OB-GYN, 12 percent a year. These are whopping, large numbers. So the likelihood of being able to go an entire career and avoid being sued, very low. Now, what happens if you are sued? You are going to be labeled a bad doctor. And it is true that good doctors will make mistakes. On occasion, a good doctor will commit negligence which will injure the patient. I like to think of this as a snapshot as opposed to a movie. I mean, we take this very personally. We take care of our patients from beginning to end but once a doctor is sued, their thinking is that every patient is a plaintiff and they're being painted in a very negative light. I'd like to say I have no experience with it, sadly, I do. I was sued one time for what I perceived to be a frivolous reason. This was a many-month odyssey. Ultimately I was dropped a few weeks before trial. I never felt as if I won anything, only lost less. But that's when I started Medical Justice. What does it mean to be sued? What will you experience? Well, you'll be on the receiving end of a letter. And the letter will state that "With reckless and wanton disregard, for the safety of the patient, you've committed negligence. So this is a very disheartening experience because every doctor that I know, wakes up in the morning, hoping to do the best possible job for his or her patient. You will be judged by 12 people, a jury, who typically have little to no knowledge of medicine yet they'll be there trying to analyze and distill very complex medical topics and having to render a judgment as to whether you did right or did not do right by your patient. The average case lasts approximately four years from beginning to end. We've had some clients whose cases were filed in a different century, meaning that 1998 or 1999. So imagine having to live with a particular case for more than a decade. It boggles the mind. You will hear language from an expert, concepts from an expert that bare zero to no relation to anything that you were taught yet these are experts who have pretty good communication skills and are able to connect with the jury. You'll be told that jurors should not go online to look at reviews of you, the doctor. But it's human nature. You know they're going to go online. And if they see that you're an arrogant individual, you don't listen. I think that plays a role in terms of helping a juror make a decision, right or wrong about whether you've committed malpractice. You're told to hold it inside. You're told not to communicate with anyone. I don't know about you but it's very difficult to hold a very stressful event inside and not talk to your colleagues, your peers, or even your family about this particular matter. In short, it is a very stressful experience. Attorneys will ask me, "Why don't we just treat it like an automobile accident and just turn it over to our carrier and be done with it?" The short answer is because the two have nothing in common. When you're sued, it is an assault on your reputation. Who you are, what you do. When I'm sued for an auto accident, I don't think myself the worst driver, I just turn it over to my insurance carrier and I'm done with it. But when someone sues you and says that you injured them, we do take it personally. Right or wrong, we perceive it as an assault on our reputation. Now doctors still need to be concerned about being sued in a court, but they also need to be worried about being sued in a small claims court.They need to be worried about complaints filed against them with the Medical board, and they need to be worried about HIPAA, and complaints filed with the Department of Health and Human Services, they need to be concerned about the FTC, they need to be concerned about the FCC, and then there are threats were patients send a note or send a letter to the doctor saying that if they don't get a refund or free surgery, there going to slam the doctor on the internet, or there going to file a particular complaint with this particular organization. How do doctors get their day in court to be vindicated without having to put their house or their nest egg at risk. Fortunately, there is something called a High/Low Agreement. It's been around for some time but it's very infrequently used. It's a technique that you must know about. The alternative is that you'll just write a check for a million dollars, the case goes away. But that doesn't feel good to a doctor who believes he did everything right in taking care of a patient. It's a contract, an agreement, that each side enters into before court. So, the doctor still presents his case to the jury and the jury renders it's verdict. But ultimately what the doctor pays and what gets paid to the plaintiff is determined by this agreement. Let me give you an example. So, the before picture is, could be anywhere from zero to ten million dollars. But with the agreement, it may have bookends of a hundred thousand dollars to a million dollars. So, in this particular case if the jury comes back and says, "The doctor is liable and owes ten million dollars." Because of the agreement the doctor only owes one million dollars. Policy limits. He does not lose his house. On the other hand, if the jury comes back and says the doctor wins and otherwise owes nothing to the plaintiff, here because of the agreement the insurance company needs to write a hundred thousand dollar check. So, the patient, or the plaintiff, walks away with something. The good news is that even though that the patient receives some money, in this case a hundred thousand dollars, it's not reportable to the data bank. She was livid stating that the doctor had violated HIPAA because he had communicated with another doctor about her treatment without her written authorization. And the truth is is that a doctor is allowed to communicate with another treating doctor whether or not a patient signs a HIPAA release. But this patient didn't know it and this doctor didn't quite understand the intricacies of HIPAA.
