Jeff: Let's dive a little bit into online reviews and responding because that's a hornet's nest. I think there's a default assumption that if a patient has outed themselves, meaning they've given their name and their picture, and they're talking about their own medical condition, meaning that I'm their doctor and this is what I did to them, that it's okay for the doctor to correct the record or to fill in the blanks because the patient has impliedly opened the door. Mike: Opened the door to the topic and that would make sense, and that's what we would think. But I'm telling you that the law is not written that way. I as a patient could put my information all over the side of a bus going through downtown Manhattan, but my physician could not respond to anything that I put that was inaccurate. Let's say I said bad things about the care that I received, that were totally inaccurate. Can they step in and say, I'm the physician and I'm here to tell you that Sacopulos was off his meds when he wrote that and we need to do something about this, this is not fair to my staff and to myself and my practice? You can't do that. It's just that simple. You can not respond in that fashion and call somebody out and start to go into detail unless you have that patient's permission. Jeff: So, one of the things we do with eMerit is give doctors the ability to respond in a HIPAA compliant way online. I think it's safe to say that having a broad and deep understanding of HIPAA would be the prerequisite to being able to respond. Meaning that there are ways to respond to potentially set a record straight but your hands are tied to some degree depending upon what the patient is already released about their own medical information. Mike: Absolutely, there are ways to do it. You just want to be very careful about how it's done and make sure that it is done in a compliant way. And the truth is is that a doctor is allowed to communicate with another treating doctor whether or not a patient signs a HIPAA release.
