I'd like to say I have no experience with it, sadly, I do. I was sued one time for what I perceived to be a frivolous reason. This was a many-month odyssey. Ultimately I was dropped a few weeks before trial. I never felt as if I won anything, only lost less. But that's when I started Medical Justice. What does it mean to be sued? What will you experience? Well, you'll be on the receiving end of a letter. And the letter will state that "With reckless and wanton disregard, for the safety of the patient, you've committed negligence. So this is a very disheartening experience because every doctor that I know, wakes up in the morning, hoping to do the best possible job for his or her patient. You will be judged by 12 people, a jury, who typically have little to no knowledge of medicine yet they'll be there trying to analyze and distill very complex medical topics and having to render a judgment as to whether you did right or did not do right by your patient. The average case lasts approximately four years from beginning to end. We've had some clients whose cases were filed in a different century, meaning that 1998 or 1999. So imagine having to live with a particular case for more than a decade. It boggles the mind. You will hear language from an expert, concepts from an expert that bare zero to no relation to anything that you were taught yet these are experts who have pretty good communication skills and are able to connect with the jury. You'll be told that jurors should not go online to look at reviews of you, the doctor. But it's human nature. You know they're going to go online. And if they see that you're an arrogant individual, you don't listen. I think that plays a role in terms of helping a juror make a decision, right or wrong about whether you've committed malpractice. You're told to hold it inside. You're told not to communicate with anyone. I don't know about you but it's very difficult to hold a very stressful event inside and not talk to your colleagues, your peers, or even your family about this particular matter. In short, it is a very stressful experience. Attorneys will ask me, "Why don't we just treat it like an automobile accident and just turn it over to our carrier and be done with it?" The short answer is because the two have nothing in common. When you're sued, it is an assault on your reputation. Who you are, what you do. When I'm sued for an auto accident, I don't think myself the worst driver, I just turn it over to my insurance carrier and I'm done with it. But when someone sues you and says that you injured them, we do take it personally. Right or wrong, we perceive it as an assault on our reputation. The remaining find their doctors initially by other means, but still search online for information about these doctors. Doctors have a vested interest to be on Google page one search and have a healthy profile on review sites. Video Transcript: Things don't always happen at light speed in healthcare and information technology and reviews in healthcare - late to the party. But, the reviews are here to stay, they're not going anywhere. What does that mean? People are relying on this information to make decisions about who to see, particularly when they're ill. They provide a valuable service to the public. So it's a fantasy to believe that these reviews do not matter. Patients out there are relying on this information to decide who to go see. This is the most important decision many of us will make in our lifetime. eMerit has a survey system which asks patients, if you are a new patient, how did you find the doctor? And our statistics, every year this number is growing and growing, we have found that 25% of new patients found their doctor initially on the internet. Not generally on the internet, but initially on the internet. And for the other patients that are out there, they are using the internet to validate that decision, meaning that if they find the doctor through friend or family, or a referring doctor, they're still going to the internet. How do we know that? We're asking the patients through our survey system. And when I say the internet, we're asking very pointed questions, meaning at which site did you find them on? They say they're finding them on Google page 1 search, they're finding them on the dominant reviews sites that are out there on the internet. So patients are naming names. Today we're going to talk about how to find the best doctor. Do we get a young doctor who is up to speed with the latest and greatest techniques or do you get a seasoned veteran, someone with a few grey hairs or maybe no hair at all. eMerit is a system that has given us credibility to talk about this. How we can identify who the best practitioners are and then give you this information how you can find the best practitioner. So, I'm often asked, "Well, who do I get? Do I get someone who just graduated from a great residency program or do I get someone who's been out and about for awhile and has the benefit of having seen lots of patients?" A recent graduate will be more likely to have been exposed to cutting edge treatments and techniques. On the other hand someone who's been out in the field for a period of time will have the benefit of both experience and wisdom. Experience does matter. It is useful to find a surgeon or a diagnostician who's been around the block before. These are people who often become a bit more conservative as they get older. They don't always recommend the latest and greatest because they recognize that over time the latest and greatest isn't always so great. You do want someone who understands cutting edge treatments and how to make good diagnoses. You also want someone who has the benefit of experience and wisdom. So how to you put this all together? Well, one way is to see what patients are saying about the doctor on the Internet. You're trying to find people who are like you. People who are experiencing the same type of condition that you have and if you can listen to their narrative or read their narratives you'll get a better feel as to which one of these two makes the most sense for you; namely latest and greatest or experience.
